AMY FALLOWS ASSOCIATE SOLICITOR IN OUR FAMILY LAW TEAM PROVIDES UPDATE.
The moment many separated couples have been waiting for is nearly here… the true ‘quickie divorce’.
A law should be passed by Parliament in the next few days which will allow couples to divorce if they wish. Currently one spouse has to cite unreasonable behaviour or adultery if they want to divorce straight away. Many instead opt to wait 2 years so that they can divorce based on 2 years separation with consent.
Family lawyers have been campaigning for ‘no-fault’ divorce for a long time. The current system requires ‘mud-throwing’ to achieve a divorce. The process raises the temperature of the proceedings and can set the scene for a battle. The new law should enable spouses to divorce in a civilised way without having to point the finger.
All those couples who are waiting for 2 years to pass will now be able to fast-forward the process. It is often important to get matters concluded before moving on. The new law will enable couples to do just that.
The Cartmells family team has supported no-fault divorce for some time and welcome the legal development. If you would like to know more about finalising your divorce please do get in touch with the team by calling 01228 585716.
The family team are continuing to offer telephone and video appointments during the Covid-19 crisis.
